MLO License Requirements by State: State-Specific Education Hours and Where to Check the Rest
Every state applies the same SAFE Act floor and accepts the same national test, but 38 NMLS agencies add state-specific education hours, some states have two licensing agencies, and bonds, background checks and renewal deadlines differ. Here's NMLS's state table, real examples from state regulators, and where to look up your own state.
Short answer
Every state licenses MLOs to the same federal minimum: 20 hours of NMLS-approved pre-licensing education, a 75% score on the one national SAFE MLO Test, a fingerprint background check, a credit report, and 8 hours of CE a year. States add to it. NMLS's August 2026 table lists 38 agencies that require state-specific education hours; in some the hours fit inside the 20, in others the total rises, up to 30 in Nevada. States also differ on which agency licenses you, bonds and insurance, extra background checks, financial standards and renewal deadlines.
"MLO license requirements by state" sounds like 50 different rulebooks. In practice it's one federal floor that every state must meet, plus a shorter list of things states add on top. Knowing which is which saves you from buying the wrong course or missing a state step.
What every state requires for an MLO license
Regulation H (12 CFR 1008.105) sets the minimum for every state license: no revoked MLO license, the felony rules, financial responsibility and character, at least 20 hours of NMLS-approved pre-licensing education, at least 75% on the SAFE MLO Test, coverage by a net worth or bond requirement or a state fund, fingerprints for an FBI check, and a credit report through NMLS. Renewal is at least yearly with 8 hours of CE. The MLO license guide walks through each step.
One national test for every state
There's no separate state exam any more. NMLS's fee history lists the state test components, at $69 each, as eliminated in 2018, and its testing FAQ says a pass meets the test requirement of every state agency. The test's Uniform State Content area (11%) covers the SAFE Act and model state law rather than any one state's statute. For that area, 57 flashcards on Uniform State Content are planned for full SAFE MLO prep.
The NMLS table of state-specific MLO education hours
NMLS's course rules let a state reserve part of the 20 hours' 12 elective hours for its own law, or require hours on top of the 20 (and the same for the 1 elective hour of CE). Its State-Specific Education Requirements page, in an August 3, 2026 version, lists the agencies that require state-specific hours:
| Agency | State PE hours | Total PE hours | State CE hours | Total CE hours |
|---|---|---|---|---|
| Arizona | 4 | 20 | 1 | 8 |

How to read it: where the total PE is 20, the state hours come out of the 20 (Colorado, for example, is 3 federal law, 3 ethics, 2 nontraditional lending, 10 electives and 2 hours of Colorado law). Where the total is higher, you take extra hours: 22 in Washington and Nebraska, 23 for Texas (SML), 24 in North Carolina, Ohio and West Virginia, 25 for Utah (DRE) and 30 in Nevada.
Agencies that aren't in the table, such as Virginia, use the standard 20 hours with no state-specific hours. NMLS's Virginia page (October 2026) gives the plain 3/3/2/12 split.
States with two MLO licensing agencies
The CSBS renewal chart that NMLS links to lists two MLO licensing agencies in five states, and NMLS's education table treats them differently:
| State | Agencies | What differs in NMLS's table |
|---|---|---|
| California | Department of Financial Protection and Innovation (DFPI); Department of Real Estate (DRE) | DFPI requires 2 state PE hours and 1 CE hour; DRE isn't in the table |
| Indiana | Department of Financial Institutions (DFI); Secretary of State (SOS) | SOS requires 2 state PE hours; DFI isn't in the table |
| South Carolina | Board of Financial Institutions (BFI); Department of Consumer Affairs (DCA) | Both require 3 state PE hours and 1 CE hour |
| Texas | Office of Consumer Credit Commissioner (OCCC); Department of Savings and Mortgage Lending (SML) | SML requires 23 total PE hours; OCCC isn't in the table |
| Utah | Department of Financial Institutions (DFI); Division of Real Estate (DRE) | DRE requires 25 total PE hours and 9 CE hours; DFI isn't in the table |
In California, for example, the two agencies issue different things: the DRE's MLO license is an endorsement on a DRE real estate broker or salesperson license, and the DRE says an endorsement renewal won't be approved if the underlying real estate license is expired, revoked, suspended or surrendered. Ask your employer which agency licenses its MLOs before you buy a course.
Beyond education: what else changes from state to state
Each row gives an example from a state regulator's own pages or from NMLS. Your state may handle it differently.
| Requirement | Example |
|---|---|
| Bonds and insurance | Colorado requires active MLOs to carry errors and omissions insurance and a surety bond (individual minimum $25,000). Washington requires an individual bond only if the employer is exempt or uses a bond substitute |
| A second background check | Colorado requires fingerprints through the Colorado Bureau of Investigation in addition to the NMLS background check, and an application in its own database as well as NMLS |
| Financial responsibility rules | Washington makes you ineligible with $100,000 or more in tax liens and lists the credit factors it reviews |
| Criminal history beyond the federal floor | Washington also bars applicants convicted of a gross misdemeanor involving dishonesty or financial misconduct |
| Minimum age | Washington: 18 or older |
| Fees | Colorado's MLO application fee is $5; Delaware charges a $250 investigation fee plus a $250 licensing fee |
| Renewal deadline | Delaware requires renewals by December 1; most states use December 31 |
| Remote work | NMLS's guidebook says whether MLOs may work remotely, and on what terms, is shown on state checklists |
| Pre-licensing course expiration | NMLS's 3-year PE expiration policy applies only in agencies that enacted it; Colorado and Virginia list it as "Enacted" |
| Temporary authority | Not every license is eligible; NMLS points to its License Requirements and Fees Chart |
The MLO background check and credit guide goes deeper on the financial and criminal standards, and the MLO license cost guide collects the fees.
Getting licensed in more than one state
- One test. While your pass is valid, it counts for every state, so adding a state doesn't mean another SAFE MLO Test
- Each state's education. Complete that state's state-specific hours, and its extra total hours if it has them
- Each state's CE. NMLS's CE FAQ gives an example: an MLO licensed in Oregon who adds a Washington license in 2021 still had to complete 2021 CE, including Washington's state hour, to renew both
- Per-license fees. NMLS's set-up and annual processing fees are charged per state license
- Temporary authority. A licensed MLO moving to a company in another state may be able to originate there for up to 120 days while the new application is pending, if eligible; the registered vs state-licensed MLO guide has the rules
Only the test carries across states unchanged, which is why planned full SAFE MLO prep covers that national test rather than each state's add-ons.
Where to check your state's MLO requirements
- NMLS's State-Specific Education Requirements page for your agency's hours, PE expiration status and CE deadline
- NMLS's State Licensing Checklist Compiler for the documents and steps your agency requires
- NMLS's License Requirements and Fees Chart for fees, temporary authority eligibility and remote-work rules
- The CSBS Renewal Deadlines, Requirements, and Fees Chart for renewal dates and fees
- Your state regulator's own site, which has the final word
Start your course only once you know your agency and its hours. Then the free SAFE MLO study planner can build the test part around your course end date, and full SAFE MLO prep planned for launch adds a 120-question timed mock exam; checkout isn't open yet.
