Terms of Use

These Terms of Use (“Terms”) are an agreement between you and TRENDING MOBAPPS SRL for your use of the Passy mobile applications and related mobile services (the “Apps,” the “App,” or the “Services”).

By downloading, installing, or using an App, you agree to these Terms. If you do not agree, do not use the Apps.

Use of the Apps is also subject to the Privacy Policy and to the terms of Apple, Google, or any other platform you use to obtain the Apps.

The Apps are provided by TRENDING MOBAPPS SRL. Passy is a family of exam-preparation mobile applications. We may offer different exam-specific Apps under that family. These Terms apply to the family as a whole and do not need to name each exam.

You may use the Apps only if you are legally capable of entering into a binding contract in your jurisdiction, or if you use them with the involvement of a parent or guardian where that is required for a minor. You must comply with any age or eligibility rules of the applicable app store and of the exam you are preparing for.

These Terms do not impose a universal requirement that users be 18 or older.

Passy provides exam-preparation and educational tools. Passy does not administer the exams you may be studying for, is not the official exam provider, and is not a licensing, certification, admissions, or employment authority.

Passy does not guarantee:

• certification, licensure, admission, or employment;
• a passing score or any particular score;
• first-attempt success; or
• that using the Apps will satisfy any official requirement.

The Apps do not replace official candidate handbooks, exam-provider rules, course requirements, or professional instruction.

Exam names, certification marks, trademarks, and other third-party marks referenced in the Apps are the property of their respective owners. Passy is not affiliated with, endorsed by, sponsored by, or approved by those owners unless we expressly say so in writing.

References to exams or organizations are for identification and education only.

Subject to these Terms and the applicable store rules, TRENDING MOBAPPS SRL grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Apps on devices you own or control, solely for your own educational use.

We do not sell you the Apps or Passy content. All rights not expressly granted are reserved.

You may not, except to the extent applicable law does not allow us to restrict it:

• copy, sell, sublicense, or commercially redistribute Passy content;
• scrape, harvest, or systematically extract the question bank or other App content;
• reverse engineer, decompile, or attempt to derive source code of the Apps;
• use bots, scripts, or other automated means to abuse the Apps;
• circumvent subscription, preview, or other access controls;
• share paid access in a way that violates these Terms or store rules;
• attack, probe, or disrupt the security or availability of the Services; or
• use Passy to build a competing question bank through automated extraction of our materials.

Reasonable personal study, including notes you take for yourself, is allowed. Mandatory legal exceptions (including those that cannot be waived in your country) remain intact.

The Apps, including their design, software, original questions, explanations, graphics, trademarks, and other original Passy content, are owned by TRENDING MOBAPPS SRL or its licensors and are protected by intellectual-property laws.

Third-party exam names and marks remain the property of their owners.

Passy questions and explanations are independently created study materials unless we clearly state otherwise. Passy does not claim that its questions are actual live exam items.

You may not submit or distribute recalled secure exam content through Passy. If you believe content infringes your rights, contact contact@passyprep.com.

Some Apps or offers may include a free trial or introductory price. Not every Passy App always provides a trial.

If a trial or introductory offer is available, the duration and conversion terms are shown at purchase and in the store. Unless you cancel through the platform’s subscription management before the trial or offer ends as those terms require, the subscription may convert to a paid auto-renewing plan at the then-current price shown by the store.

Purchases and refunds are processed under the applicable Apple App Store or Google Play policies and under mandatory consumer law. Passy does not control store billing and does not promise a Passy-operated refund outside those rules.

Nothing in these Terms limits refund or withdrawal rights you cannot waive under the law of your country of residence.

We may modify features, update educational content, correct errors, and add or remove exam support. We do not promise uninterrupted, error-free, or perpetual availability of any feature.

Changes are subject to applicable law, including rules on digital content and consumer contracts where they apply.

We aim to keep study material accurate and current, but exams, scoring rules, eligibility, fees, and professional regulations change. Candidates remain responsible for checking current official exam-provider requirements.

Some Apps may offer AI-supported explanations or other generated study help. That output can contain errors, omissions, or outdated statements. You should verify high-stakes factual information against authoritative sources.

AI features are not medical, legal, pharmacy, clinical, or other professional advice, and they are not a substitute for official exam materials.

Passy is educational. It is not medical advice, legal advice, clinical advice, pharmacy advice, or professional licensing advice. Use of the Apps does not create a professional–client relationship.

You agree to use the Apps lawfully and in good faith, not to interfere with other users or our systems, and not to misrepresent your affiliation with Passy or with any exam provider.

Apple, Google, Expo, hosting providers, and other third parties have their own terms and privacy policies. Your use of those services is also governed by those terms. Passy is not responsible for third-party services we do not control.

If you download or use an iOS version of a Passy App, the following additional terms apply. They are intended to meet Apple’s requirements for a custom end-user license. They do not copy Apple’s Standard EULA. Your use of iOS Apps is also subject to the Apple Media Services Terms and Conditions and Apple’s Usage Rules.

• These Terms are between you and TRENDING MOBAPPS SRL, not Apple. Apple is not a party to this agreement and is not responsible for the Apps or their content.
• TRENDING MOBAPPS SRL, not Apple, is responsible for the Apps and for Passy content.
• The license granted to you is limited and non-transferable, and it may be used only on Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms.
• Apple has no obligation to provide any maintenance or support for the Apps. TRENDING MOBAPPS SRL is responsible for support to the extent described in these Terms and in the App.
• To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the Apps. If the Apps fail to conform to any applicable warranty that cannot be disclaimed, you may notify Apple, and Apple may refund the purchase price you paid to Apple for the App. To the maximum extent permitted by law, Apple will have no other warranty obligation. TRENDING MOBAPPS SRL remains responsible for any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty, to the extent required by law.
• TRENDING MOBAPPS SRL, not Apple, is responsible for addressing any claims relating to the Apps or your possession and use of them, including product-liability claims, any claim that the Apps fail to conform to legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar legislation, in each case to the extent required by applicable law.
• In the event of any third-party claim that the Apps or your possession and use of the Apps infringe that third party’s intellectual-property rights, TRENDING MOBAPPS SRL, not Apple, will be responsible for the investigation, defense, settlement, and discharge of that claim, to the extent required by applicable law.
• You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties, in each case where such representations are legally required for App Store distribution.
• You must comply with applicable third-party terms when using the Apps (for example, your wireless-data agreement).
• Apple and Apple’s subsidiaries are third-party beneficiaries of this Apple-specific section. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Apple-specific section against you as a third-party beneficiary.

If you download or use an Android version of a Passy App from Google Play, Google is not a party to the agreement between you and TRENDING MOBAPPS SRL. Google does not provide Passy’s educational content or Passy support.

Google Play distribution and in-app purchases, including subscriptions billed through Google Play, are also governed by Google’s applicable terms (including the Google Play Terms of Service and payment terms). Those terms do not mean that Google endorses Passy.

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where those disclaimers are not allowed.

We do not warrant that the Apps will meet your exam goals or that content is complete or error-free. This disclaimer does not affect non-waivable consumer warranties or statutory guarantees.

To the maximum extent permitted by applicable law, TRENDING MOBAPPS SRL and its directors, employees, and suppliers will not be liable for lost profits, lost exam opportunities, lost data, or indirect, incidental, special, consequential, or punitive damages arising out of the Services or these Terms, even if we have been advised of the possibility of such damages.

These Terms do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under the law of your country of residence. They do not set an arbitrary numerical cap on damages.

To the extent permitted by applicable law, you agree to indemnify TRENDING MOBAPPS SRL against losses, costs, and reasonable legal fees arising from your unlawful use of the Apps or your material breach of these Terms, except to the extent the loss is caused by our negligence, willful misconduct, or breach of these Terms. This clause is not intended to require consumers to indemnify us where local consumer law does not allow it.

We may suspend or terminate your license to use the Apps if you materially violate these Terms or if we are required to do so by law or by a platform. You may stop using the Apps at any time by uninstalling them. Provisions that by their nature should survive (including intellectual property, disclaimers, liability limits, and governing law) will survive.

Termination of the license does not, by itself, cancel a store subscription. Cancel billing in the store.

TRENDING MOBAPPS SRL is a Romanian company in the European Union. These Terms are governed by the laws of Romania and by applicable European Union law, without limiting mandatory consumer-protection rules of your country of residence.

If you are a consumer, you may bring proceedings in the courts of your place of residence, and other mandatory jurisdiction rules may apply. These Terms do not require arbitration and do not include a class-action waiver.

We may update these Terms. The “Last updated” date at the top will change when we publish a revision. If you continue to use the Apps after updated Terms take effect, you accept the revised Terms, except where applicable law requires additional notice or consent.

If a provision of these Terms is held unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

These Terms, together with the Privacy Policy and any additional in-app disclosures we present for a specific feature, are the entire agreement between you and TRENDING MOBAPPS SRL for the Apps. They do not replace Apple’s or Google’s terms for store accounts, billing, or device software.
